OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees accessed the dairy parlors return lanes amongst dairy cows in a manner that exposed them to hazards associated with being pinned between the animals and/or between the animals and the return lanes fencing structure: (a) On or about December 28, 2015, a 30-year-old male employee was seriously injured as a result of being struck by dairy cows while herding dairy cows from inside of one of the dairy parlors' return lanes. The employer did not ensure that its employees were protected from crushed-by hazards when performing animal transfer activities in this area.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein: a) On or about January 4, 2016, in the milking parlor, employees used Astro-tek post dip, an iodine based teat dip, to clean the teats of the cows from an unlabeled 1 gallon container. b) On or about January 4, 2016, 2016 in the utility/chemical room, employees used Derma Sept post dip, a glycol teat conditioner, to clean the teats of the cows from a mislabeled container that read Spectramast LC lactating cow formula. c) On or about January 4, 2016, in the milking parlor, employees used Thera-con 1 pre dip, an iodine based teat dip, to clean the teats of the cows from a mislabeled 1 gallon container that read Isopropyl Alcohol 70%.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a) On or about January 4, 2016, in the milking parlor, employees used an unlabeled gallon container of Astro-tek post dip, an iodine based teat dip, to clean the teats of the cows. The container did not have a product identifier with words, pictures, symbols, or combination thereof that provided at least general information regarding the physical and health hazards of the chemical. b) On or about January 4, 2016, in the utility/chemical room, employees used a mislabeled iodine base container of Derma Sept post dip, a glycol teat conditioner, to clean the teats of the cows. The container did not have the correct product identifier with words, pictures, symbols, or combination thereof that provided at least general information regarding the physical and health hazards of the chemical. c) On or about January 4, 2016, in the milking parlor, employees used a mislabeled iodine base container of Thera-con 1 pre dip, an iodine based teat dip, to clean the teats of the cows. The container did not have the correct product identifier with words, pictures, symbols, or combination thereof that provided at least general information regarding the physical and health hazards of the chemical.
