OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a 17 foot fall hazard:  a.  On or about January 8, 2016 on the north side of a new commercial structure, an employees was operating a variable reach boom type rough terrain forklift without wearing the seatbelt provided on the forklift, exposing the employee to the hazard of being pinned between a forklift and the ground and death in the event of a tipover.
