29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Eastside of the building - On or about On or about January 7, 2016 three employees were exposed a fall hazard while riding in a Genie S-40 Boom Lift elevated 16 feet above the ground without fall protection. Also this aerial lifts occupancy capacity was exceeded. This aerial lift has maximum occupancy of 2 passengers.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer shall not be exceeded. (a) Eastside of the building - On or about On or about January 7, 2016 three employees were exposed a fall hazard while riding in a Genie S-40 Boom Lift due to an exceeded occupancy capacity. This aerial lift has a warning sticker on the front that reads Maximum of 2 Occupants or 500 lbs. All three of these employees were elevated 16 feet above the ground without fall protection. The operators manual also states maximum capacity of 2 occupants.

29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable: (a) DS Precision Walls - On or about January 7, 2016 three employees were exposed to a fall hazard while working in a Genie S-40 Boom Lift. The employer and employees stated no training was provided about the hazards of associated with working on an aerial lift (mobile scaffold).
