29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) 3 Church Street, Tompkins Cove, NY:   On or about 12/4/15 to 12/5/15, employees prepared, handled and used Rub-R-Wall Waterproofing (Category 2 Flammable Liquid - Solvent Mixture) and the employer did not instruct employees in the following:  1. Procedures and equipment to ground the truck (e.g., copper grounding rod).  2. Procedures and equipment to ground the 55-gallon drums of Rub-R-Wall Waterproofing being used inside the truck.   3. The potential for the accumulation of flammable vapors inside the truck while Rub-R-Wall (Category 2 Flammable Liquid - Solvent Mixture) was being heated, circulated and sprayed and methods to prevent the potential accumulation of flammable vapors.  4. The potential for accumulation of flammable vapors due to the site configuration requiring parking on a hill that could result in the accumulation of flammable vapors inside the cargo area of the truck.  5. Procedures and proper use of equipment to ensure that Rub-R-Wall is not heated above 160 deg. F.

29 CFR 1926.152(f)(3): Flammable liquids were used where there were open flames or other sources of ignition within 50 feet of the operation:    a) 3 Church Street, Tompkins Cove, NY - Inside the back of the company box truck: On or about 12/4/15 to 12/5/15 Rub-R-Wall Waterproofing (Category 2  Flammable Liquid) was heated and then pumped from a 55-gallon drum within 50 feet of ignition sources (e.g., sparks, hot surface temperatures) associated with the use of an electric cord and plug type Uline H-4931 Heavy Duty Drum Heater, a Honda Generator ES6500 (gasoline-powered motor), an Emglo K5HGA-8P Air Compressor (gasoline-powered motor), and a 2004 Spray Hog Commercial Hydraulic Airless Sprayer or equivalent (diesel powered motor).     b) 3 Church Street, Tompkins Cove, NY - Inside the back of the company box truck:  On or about 12/4/15 to 12/5/15 Rub-R-Wall Waterproofing (Category 2  Flammable Liquid) was heated and then pumped  from an approximately 55-gallon drum within 50 feet of ignition sources (e.g., static electricity) associated with operation of and lack of grounding of a Uline H-4931 Heavy Duty Drum Heater, a Honda Generator ES6500, an Emglo K5HGA-8P Air Compressor and a 2004 Spray Hog Commercial Hydraulic Airless Sprayer or equivalent.
