29 CFR 1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered: The return tank that feeds the boiler system located in lower level parking garage at the Sphere Apt. complex (formerly know as The Chesterfield) located at 1801 E. 12th St., in Cleveland, OH, was not evaluated by the employer to determine whether or not it was a permit-required confined space. Employees who entered the tank, which measured approximately 10 ft. x 4 ft. (in height circumferential) to clean it and when applying a paintable water proofing product to the interior of the tank were potentially exposed to a hazardous atmosphere from the product off-gassing due to the lack of good general ventilation in the permit-required confined space.

29 CFR 1910.146(d)(3)(iv): Under the permit space program, the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, purging, inerting, flushing or ventilation the permit spaces as necessary to eleminate or control atmospheric hazards: On or about 11/06/2015, at the Sphere Apt. complex (formerly know as The Chesterfield) located at 1801 E. 12th St., in Cleveland, OH, employees entered into a permit-required confined space for the purpose of cleaning it and to apply a paintable water proofing material to the interior walls of the tank which measured 10 ft. x 4 ft. (in circumference) and had a manhole opening of 2-2.5 ft. A small fan was used for mechanical ventilation but did not provide the required exchange of diluted air needed when working within the permit-required confined space. The employee was not trained in the hazards to be encountered when the possibility of oxygen deficient air was encountered therefore exposing the employee to atmosphere hazards.
