29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  a)  3902 W Wapoot Street, Meridian, Idaho:  On or about January 14, 2016, employees involved in framing activities were not utilizing protective eye protection when observed utilizing a pneumatic nail gun.  b) 3902 W Wapoot Street, Meridian, Idaho:  On or about January 14, 2016, employees involved in framing activities and exposed to overhead hazards on this multi-story residential structure.  Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) 3902 W. Wapoot Street, Meridian, Idaho: On or about January 14, 2016, and at times prior thereto, employees observed in a variety of framing activities on this multi-story residential complex without using any means of fall protection were exposed to fall hazards ranging up to 18 feet.   Note: Abatement certification IS required for this item.
