29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high. The employer is failing to protect employees from fall hazards when they are working in the vicinity of a ladder system and floor hole. This was most recently documented at 1850 P Street, Lincoln NE, 2nd Floor, where employees were observed in the area of guardrail systems constructed without mid rails. The guardrails were installed around ladder access points and constructed with lumber (2X4) consisting of top-rails and vertical members. The floor holes each had falls to the next lower level of over 9 feet. a. 2nd floor East Ladder access point; mid-rails were not installed. b. 2nd floor West Ladder access point; mid-rails were not installed. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.

29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: The employer is failing to protect employees from fall hazards when they are working in the vicinity of a ladder system and floor hole. This was most recently documented at 1850 P Street, Lincoln NE, 2nd Floor East Ladder access, when employees were observed in the area of a guardrail system which was not built to withstand 200 pounds of force. The guardrail system was constructed with lumber (2X4) and withstood minimal pressure before exhibiting signs of failure. Abatement certification is required for this violation. This was most recently documented at 1850 P Street, Lincoln Nebraska, where employees were observed in the area of guardrail systems built to prevent falls into a ladder hole. The guardrail systems on the 2nd floor were not equipped with either gates or offset guardrails. The floor holes each had falls to the next lower level of over 9 feet. a. 2nd floor East Ladder access point; there was not any type of offset guardrail or gate. b. 2nd floor West Ladder access point; there was not any type of offset guardrail or gate. Worksite located at 1850 P Street, Lincoln NE: The employer is failing to protect employees from fall hazards when they are performing framing activities. This was most recently documented at 1850 P Street, Lincoln NE, 2nd Floor, when seven employees were observed setting 1st floor trusses and working at heights of approximately 12 feet without fall protection. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.
