29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. a) 10th and N. Market Streets - On or about November 4, 2015, the employer failed to protect their employees from injury by not fully planking the rolling scaffold which was missing approximately three of it's planks. The scaffolding was being used to climb up and down off of the bus shelter's roof and also to stand on while painting.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) 10th and N. Market Streets- On or about November 4, 2015 the employer failed to protect their employee from a fall of approximately 12 feet while working from the apex of the bus shelter roof. An employee was seen working on the roof without fall protection.

Market Streets - On or about November 4, 2015 employees were instructed to paint a metal roof that is approximately 12 feet above ground level without being provided the necessary training and equipment while performing construction related activities, 6 feet or greater above ground level.
