29 CFR 1910.1030(c)(1)(iv): The Exposure Control Plan (ECP) was not reviewed and updated at least annually and whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure.    (a)  The Urology Center of Colorado, 2777 Mile High Stadium Circle, Denver, CO 80211: On and before January 11, 2016, the employer did not review and update their Exposure Control Plan on an annual basis. The employer provided Exposure control plans that were updated in 2016, and 2012.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").    Abatement Note: The review and update should:     (A) Reflect changes in technology that eliminate or reduce exposure to bloodborne pathogens; and    (B) Document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  (a)    The Urology Center of Colorado, 2777 Mile High Stadium Circle, Denver, CO 80211: On and before January 11, 2016, the employer did not solicit input from non-managerial employees in the evaluation and selection of safer medical devices. The employer could not provide documentation regarding non-managerial input. The Exposure Control Plan provided did not contain the required lists.   Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").  Abatement Note: The exposure determination should contain the following:  [A] A list of all job classifications in which all employees in those job classifications have occupational exposure;  [B] A list of job classifications in which some employees have occupational exposure, and  [C] A list of all tasks and procedures or groups of closely related task and procedures in which occupational exposure occurs and that are performed by employees in job classifications listed in accordance with the provisions of paragraph (c)(2)(i)(B) of this standard.

Since the program did not contain these sections, the employees were not adequately trained.
