OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that front loader operators were exposed to the hazard of engulfment while removing material from the base or toe of a stockpile:  a) For the front loader operators removing material from the sulfur stockpile on 01/15/2016, at 5740 Pembroke Road, Gibsonton, FL.  A front loader operator, while moving material from the base of the stockpile, suffered asphyxia from material that engulfed the inside cab area, due to a steepened face collapse. The operator had not been provided training on the handling of stockpile material.  b) For the front loader operators removing material from the sulfur stockpile on 01/15/2016, at 5740 Pembroke Road, Gibsonton, FL. A front loader operator, while moving material from the base of the stockpile, suffered asphyxia from material that engulfed the inside cab area, due to a steepened face collapse. Safe techniques and/or methods had not been developed and/or established for the safe stockpiling of sulfur material.
