29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a) At 3900 Highway 366, methanol tank site preparation area, the employer did not implement the written hazard communication program in that contractors were not informed of the hazards of chemicals to which contractor personnel may be exposed; the location of SDSs and how contractor personnel can access them; measures to be taken to protect workers from chemical hazard during normal operations and any foreseeable emergency; and the chemical labeling system used a the facility.

29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): (a) At 3900 Highway 366, methanol tank site preparation area, the Hazard Communication Program did not specify the methods the employer will use to provide contractors with access to safety data sheets; the methods the employer will use to inform contractors of any precautionary measures; and the methods the employer will use to inform the contractors of the labeling system.
