OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards during heating or drying of plastics in ovens or thermoforming tables: a. On or about January 27, 2016 and at times prior thereto, in the shop, employees heated plastic sheets at a thermoforming table in which the heating elements are below the level of the plastic sheet that is being heated. Adequate protection to prevent the plastic sheet from contacting the heating elements and causing a fire was not provided. b. On or about January 27, 2016 and at times prior thereto, in the shop, employees heated plastic at thermoforming tables and in a drying oven that lacked excess temperature limit controllers which exposes employees to fire hazards. c. On or about January 27, 2016 and at times prior thereto, in the shop, employees heated plastic in a drying oven that lacked instructions for normal operations and emergency operations which exposes employees to fire hazards. d. On or about January 27, 2016 and at times prior thereto, in the shop, employees heated plastic in a drying oven which did not have an exhaust duct that vented directly to the outside of the building which exposes employees to chemical hazards including but not limited to carbon monoxide.

On or about January 27, 2016 and at times prior thereto, the procedures for reporting a fire emergency did not include information on the automatic sprinkler systems local waterflow alarm which sounds an electric bell that is also activated by a tamper switch. Employees were expected to use portable fire extinguishers and were exposed to fire hazards where flammable liquids were sprayed and plastics were heated at thermoforming tables and in a drying oven.

29 CFR 1910.107(f)(1): In sprinklered buildings, the automatic sprinkler system in rooms containing spray finishing operations did not conform to the requirements of 1910.159: On or about January 27, 2016 and at times prior thereto, in the shop, the automatic sprinkler systems local waterflow alarm does not provide a distinct audible signal from the tamper switch. A single electric bell was used for the waterflow alarm and the tamper signal. Employees were exposed to fire hazards in that flammable liquids were sprayed and plastics were heated at thermoforming tables and in a drying oven.
