29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) On or about January 28, 2016 at 2101 Berry Hill Rd, building 7, Montgomery, Al: The employer failed to ensure an employee working from an aerial lift was connected with a lanyard between the basket and harness which exposed him to falls of approximately 33 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about January 28, 2016 at 2101 Berry Hill Rd, Building 7, Montgomery, Al: The employer failed to ensure employees caulking holes left from the pump jack bracing used proper fall protection in that one employee was holding the rope attached to the other employees lanyard as he worked near the edge of a steep pitch roof exposed to falls of 30 feet 4.6 inches.
