OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard.  At well site Outlar#1, employees exposed to struck-by hazards when circulating the well's high pressure hoses which were missing or not installed correctly with whip checks or other safety devices.

Sources of ignition may include open flames, lightning, smoking, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat:    At well site Outlar #1, employees were exposed to fire and explosion hazards while performing plug and abandoned operations (utilizing a torch) where flammable gases were present.

The employees were exposed to corrosive chemicals and natural gases where a flash fire occur.

Directional signs with Rig number at entrance in event of an emergency,  b.    Muster area posted/wind sock,   c.    Requirements of PPE (Personal Protective Equipment),  d.    No smoking signs,  e.    Eye wash location identified with visible sign, hearing protection required warning signs, and   f.     Fall protection required warning signs were not erected.

The wire ropes showed evidence of crushing, broken wires, and fraying and were not removed out of service. This exposed employees to struck-by hazards.

29 CFR 1910.1200(a)(1): The employer did not effectively ensure that the information concerning the hazards of all chemicals  to which the employees may be exposed to, was transmitted as accomplished by the means of the employer's comprehensive hazard communication programs including labeling and other forms of warning, material safety data sheets and employee training.  At the well site, employees engaged in plug and abandonment operations were exposed to chemical/materials such as, but not limited to natural gas. The employer had not developed a program which would address labeling/warnings on containers and/or dispensaries, Safety Data Sheets, and employee information and training on the hazards associated with the chemical/material exposure.
