29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a. On or about February 03, 2016, at the above addressed jobsite, an employee was operating a powered industrial vehicle (Traverselift F-844) during material handling operations. The operator of the powered industrial truck did not complete the required training and evaluation specified in paragraph (l).

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews:    a. On or about February 03, 2016, at the above addressed jobsite, employees conducting masonry operations from a tube and coupler scaffold, approximately thirty (30) feet above the lower surface, which was not provided with a complete guardrail system, thereby exposing employees to the hazards associated with falls.
