29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: On or about February 03, 2016, an employees worked from a elevated wooden platform (job made box) that was not securely attached to the lift to prevent the platform from sliding off. The platform was used on a Sky Trak rough terrain forklift to lower the employee from the rooftop on the building under construction, exposing the employee to a fall hazard of approximately 20 feet.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: On or about February 03, 2016, and at times prior thereto, a job made box was supported by rough terrain forklift and was used to elevate personnel for framing activities. The employer who designed the platform was not qualified and/or did not adhere to published guidelines for safe use and design of elevating platforms and rough terrain forklifts, such as ASME/ANSI B56.6, 2005 and specifically, section 8.24, items such as: a) A platform floor having slip resistant surface. b) A 4 inch minimum height toe plate which may be omitted at the access opening. c) Protection for personnel in their normal working position on the platform from moving parts of the rough terrain forklift truck that present a hazard. d) A means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting. e) Restraining means such as a guardrails or a means for securing personnel such as a fall protection harness. Employees were exposed to pivoting, slippage or tipping of the platforms and forklift creating a fall hazard of approximately 20 feet. The East Framing, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(a)(6), which was contained in OSHA inspection number 1016199, citation number 01, item number 003 and was affirmed as a final order on 03/20/2015, with respect to a workplace located at 271 Trinity Hills, Austin, TX 78752.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about February 03, 2016, employees used a job-made wooden box for elevating building materials and other workers to heights up to 20 feet. One employee was not protected from falling where the guardrail was only installed on two sides of the box and missing and broken on the front and back of the box. 29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart. On or about February 03, 2016, and at times prior thereto, the employer did not ensure that the employee on scaffold platform was trained to recognize unsafe conditions, exposing the employee to the hazards of falls and/or collapse/failure of the scaffold.
