OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a. On or about February 11 2016 on the north side of a commercial structure, an employee operating a Skytrack 6036 powered industrial truck (serial number 42063) did not use a seat belt exposing the employee to crushing hazards or death in the vent of a tipover.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a forklift: a. On or about February 11, 2016 on a jobsite of a commercial building, the employer did not ensure that an employee was certified to operate a Skytrack 6036, 6000 lbs. forklift, exposing employees to struck-by and crushing hazards, and decapitation. In the alternative: 1926.602(d) Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at sub-section 1910.178(l) of this chapter.
