29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system:      The employer is failing to protect employees from fall hazards.  Employees observed on a residential roof performing sheathing operations with a roof pitch of 5 X 12, exposed to fall hazards in excess of 25 feet due to the lack of fall protection.

29 CFR 1926.1052(c)(1)(ii): One stairrail system along each unprotected side or edge.    The employer is failing to protect employees from fall hazards as employees accessing the stairs on the jobsite exposed to fall hazards due to the lack of stair railings on the exposed open sides of the stairs.  The stair run leading to the first floor was not equipped with a stair railing to prevent employees from falling through the plastic sheet covered opening leading into the basement.  Employees exposed to fall height in excess of 8 to 10 feet into the basement.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings shall be provided with guardrail systems. Guardrail system criteria are contained in subpart M of this part.  The employer is failing to protect employees from fall hazards.  The employer had not installed guardrails at the bottom of the stair landing on the first level of the residential home.  At the landing on the first level, the opening into the basement was covered by a plastic sheet, thus exposing employees to fall hazard into the basement.

Employee(s) utilizing Louisville step ladder with the ladder folded and leaning against the wall in the garage on the construction site.
