OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operating  powered industrial trucks while working from a platform were exposed to fall hazards:  An employee was exposed to a fall hazard while working from a platform resting on the forks of the Yale forklift because the platform did not provide protection for personnel on the platform from moving parts on the truck that present a hazard, provide a restraining means such as a guardrail or another means of securing personnel, means to securely attach the platform to the lift carriage or forks, and the platform did not indicate the maximum work load including personnel and equipment in accordance with ANSI B56.1-2009, American National Standard for Safety Standard for Low Lift and High Lift Trucks, Section 7.37.  Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a work platform in accordance with ANSI B56.1-2009, American National Standard for Safety Standard for Low Lift and High Lift Trucks listed below:                Section 7.37.3    Work platforms (does not include operator platforms) shall comply with para. 7.37.1 and shall have:    (a)        a barrier or suitable protection for personnel on the platform that will prevent contact with the moving parts on the truck.     (b)        provide a restraining means such as a guardrail or another means of securing personnel    (c)        means to securely attach the platform to the lift carriage or forks, and to prevent the lifting carriage or forks from pivoting upward.    (d)        the following information prominently indicated on the platform:              (1)        maximum intended load including personnel and equipment              (2)        weight of the empty platform              (3)        minimum capacity of truck on which the platform can be used.
