29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 ft (0.9 m) above the upper landing surface to which the ladder was used to gain access: A) on or about 02/17/16, at the back of warehouse of 132-15 35th Ave. Flushing, NY Employees were using a portable ladder to gain access to a roof. The ladder side rails extended less than one foot above the upper landing surface. The employees were exposed to the hazard of falling approximately 16 ft. to concrete ground below. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support): A) on or about 02/17/16, at the back of warehouse of 132-15 35th Ave. Flushing, NY Employees were using a portable ladder to gain access to the roof, 16-feet above the ground. The ladder was positioned against the wall at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately 2-feet. This exposed employees to falling backwards due to the ladder being placed too close to the wall. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
