29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    a)     On or about February 9, 2016, and at times prior, the employer, Precious Cat, Inc., did not ensure employees, who were required to enter a permit-required confined space beneath incoming train cars for cleaning operations, were protected from hazards including, but not limited to, machine guarding and hazardous atmosphere.  A written permit-required confined space entry program had not been developed and implemented by the employer.
