29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:      a) On or about 3/1/16 at a Condominium Construction site at 767 Legacy Dr., Lewiston, NY: An employee of a sub-contractor was operating a Lull 1044C-54 rough terrain forklift truck that had a wooden Gable on its forks when it tipped over onto an employee JAM Niagara Inc. (the General Contractor on the site). JAM Niagara Inc. had also rented the Lull 1044C-54 to the sub-contractor.The operator was not trained in the operation of this type of vehicle, nor was his performance evaluated in the workplace, and he was not certified as being trained and evaluated.        b) On or about 3/22/16 at a Condominium Construction site at 767 Legacy Dr., Lewiston, NY:  A different employee of the same sub-contractor was observed operating a different rough terrain forklift truck (not rented to him by JAM Niagara Inc. ) on the site. This second operator was also not trained in the operation of this type of vehicle, nor was his performance evaluated in the workplace, and he was not certified as being trained and evaluated.         ABATEMENT DOCUMENTATION REQUIRED
