29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. On or about March 9, 2016, at the above addressed jobsite, employees performing carpentry operations from the porch were exposed to falls of twelve (12) feet three (3) inches, created by the presence of unprotected sides.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.  a.  On or about March 9, 2016, at the above addressed jobsite, employees were not provided with safe means of access to the porch being constructed.  Employees were thereby exposed to the hazards associated with falls.
