Employees fabricated architectural stone using precast concrete and pigment. The processes generated Particulates Not Otherwise Regulated (Total Dust). On 3/18/16 one employee loading mold frames onto the pour line was exposed to Particulates Not Otherwise Regulated (Total Dust) at a concentration greater than the 8 hour Time Weighted Average (TWA) Permissible Exposure Limit (PEL) of 15.0 mg/m3. The employee was exposed to total dust at a concentration of 51.76 mg/m3 as an 8 hour TWA. This is 3.45 times the PEL. Air monitoring was conducted for 401 minutes. Employees wore Gateway Peakfit N95 filtering facepiece respirators when working in the pouring or stripping areas. The employer did not provide a medical evaluation to determine the employee's ability to use a respirator. 29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): (a) Environmental Materials LLC, dba Environmental Stoneworks, at 6300 East Stapleton Drive South, Denver, CO: On 3/18/16, the employer did not implement feasible administrative or engineering controls to reduce and maintain employee exposure to Particulates Not Otherwise Regulated (Total Dust) in accordance with the schedule in Table Z-1 of this paragraph. Abatement Note: Feasible engineering controls include, but are not limited to: 1. Installation of local exhaust ventilation, i.e., slot hoods, at the point(s) where dust is generated. Abatement Note: Abatement of this item will normally be multi-step as follows: 1. Effective respiratory protection shall be provided and used by exposed employees as an interim protective measure until feasible engineering and/or administrative controls can be implemented or whenever such controls fail to reduce employee exposure to within exposure limits. STEP 1 ABATEMENT DATE (15 DAYS): [9/8/2016] 2. Submit to the Area Director a written detailed plan of abatement outlining a schedule for the implementation of engineering and /or administrative measures to control employee exposures to the hazardous substance referenced in this citation. The plan shall include, at a minimum, target dates for the following actions which should be consistent with the dates required by this citation: a. Evaluation of the extent and location of the hazard source; b. Evaluation of control measure options; c. Selection of optimum control measures; d. Determination of control measure design; e. Ordering and delivery of equipment; f. Installation of control measures; g. Training of employees in proper operation and maintenance of newly implemented control measures; and h. Assurance of the effective performance of control measures. All proposed control measures shall be evaluated for each particular use by a competent Industrial Hygienist or other technically qualified person. Thirty day progress reports are required during the abatement period. The progress report must identify the action taken to achieve abatement and the date the action was taken. STEP 2 ABATEMENT DATE (60 DAYS): [11/14/2016] 3. Abatement will be completed by the implementation of feasible engineering and/or administrative controls and upon verification of their effectiveness in achieving compliance. STEP 3 ABATEMENT DATE (120 DAYS): [2/10/2017]

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (a) Environmental Materials LLC, dba Environmental Stoneworks, at 6300 East Stapleton Drive South, Denver, CO: On and preceding 3/18/16, the employer did identify and evaluate the respiratory hazards in the workplace with a reasonable estimate of employee exposure and identification of the contaminant's chemical state and physical form. Employees, working in and around the demolding lines, loaded filled molds onto conveyers where manufactured stone veneer was removed from the molds and packed. Work processes generated airborne particles of Particulates Not Otherwise Regulated and Crystalline Silica. The employer did not provide a reasonable estimate of employee exposure to Particulates Not Otherwise Regulated. This condition potentially exposed employees in and around the demolding lines to respiratory hazards. (b) Environmental Materials LLC, dba Environmental Stoneworks, at 6300 East Stapleton Drive South, Denver, CO: On and preceding 3/18/16, the employer did identify and evaluate the respiratory hazards in the workplace with a reasonable estimate of employee exposure and identification of the contaminant's chemical state and physical form. Employees loaded empty molds onto the beginning of the pouline conveyers. Work processes generated airborne particles of Particulates Not Otherwise Regulated and Crystalline Silica. The employer did not evaluate employee exposure to Particulates Not Otherwise Regulated and Crystalline Silica for mold loaders. This condition potentially exposed employees in and around the pourlines to respiratory hazards.
