29 CFR 1910.146(k)(1)(iii)(B): The employer who designated rescue and emergency services, pursuant to paragraph (d)(9) of this section, did not select a rescue team or service from those evaluated that were equipped for and proficient in performing the needed rescue services Tank car cleaning area: On or about March 29, 2016, employees engaged in the cleaning the interiors of tank railcars were making permit confined space entries. The selected service did not have any experience with tank railcars and did not always have confined space trained personnel available. This exposed the employees to hazards as air contaminants, the lack of oxygen, and fire.

29 CFR 1910.146(k)(1)(iv): The employer who had designated rescue and emergency services did not inform each rescue team or service of the hazards they may confront when called to perform rescue at the site: Tank car cleaning area: On or about March 29, 2016, employees engaged in the cleaning the interiors of tank railcars were making permit confined space entries. Hazard information had not been provided to the local fire department designated to provide services. This exposed the employees to hazards as air contaminants, the lack of oxygen, and fire.
