29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the residential construction site located at 11628 158th Street in Overland Park, Kansas:  Employees engaged in roofing activities were exposed to health hazards associated with dermal, ingestion, and inhalation exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to gasoline.

Hazardous chemicals such as gasoline were used at the residential construction site.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  At the residential construction site located at 11628 158th Street in Overland Park, Kansas:  Employees engaged in residential roofing activities were exposed to fall hazards of approximately 12 feet 9 inches from the eave of the residence to the ground below while accessing and exiting the roof in that the portable ladder did not extend at least 3 feet above the upper landing and was not secured to the residence/structure.
