OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards caused by the use of PVC to transport compressed air:   On or about 4/4/2016 in the warehouse and work areas at 1030 Nine North Drive, Alpharetta, GA:  Employees were exposed to struck-by hazards during the use of compressed air to run pneumatic tools and equipment in the warehouse, storage, and work shop areas.  Where PVC piping was used to transport compressed air at about 120 PSI during work operations.   Among other methods, one feasible and acceptable abatement method to correct this hazard as recommended by the Plastic Pipe Institute is to ensure that the pipe is buried, encased in shatter resistant material, or replaced with metal (copper or iron) pipe or ABS type plastic pipe.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103)(a):  On or about 4/4/2016 in the warehouse and work areas at 1030 Nine North Drive, Alpharetta, GA: Employees are exposed to inhalation hazards when mixing and applying the chemicals used at the construction sites and main office location.  The employee use of the respirators are voluntarily, but the employer had not established and implemented a written respiratory protection program.

On or about 4/4/2016 at 1030 Nine North Drive, Alpharetta, GA:  Employees were exposed to a chemical burn and frost bite hazard while changing out propane chemicals on the powered industrial trucks without the use of proper hand protection.
