29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    a) On or about April 8, 2016, the employer did not ensure employees were removed from a hazardous situation, when the excavator bucket forks stabbed an 40 foot long abandon pipe which was 6 inch in diameter.  The competent person laid the excavator bucket to rest where as the tension that was applied to the bent pipe by the excavator bucket cause the end of the pipe to unearth striking an employee in the trench.
