OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     On April 21, 2016 at a job site located at Lot 96 Cloverhurst St NE, Canton, Ohio 44721; an employee was exposed to a fall hazard of approximately 12 feet while using the bucket of a KOBELCO Excavator, Model SK160LC, Serial Number  YM03-U1489 as a means of access and or egress from a 10.2 feet deep trench.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.     On or about April 21, 2016, at a job-site located at Lot 96 Cloverhurst St NE, Canton, Ohio 44721; the employer did not ensure an employee had means of access and egress while working inside a trench that had near vertical side walls and a depth of approximately 10.2 feet.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).      On or about April 21, 2016, at a job-site located at Lot 96 Cloverhurst St NE, Canton, Ohio 44720; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth varying from approximately 7.3 to 10.2 feet.  The trench was determined to have type "C" soil.
