29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 4/18/16 at a construction project located at 6519 East Quaker Road, Orchard Park, New York; employees installing an HVAC unit on the roof of the building were using an articulating boom lift to access work areas. The employees in the lift did not have a harnesses with lanyard attached to the boom or basket.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) On or about 4/18/16 at a construction project located at 6519 East Quaker Road, Orchard Park, New York; employees were installing an HVAC unit on the roof of a 2 story building. There was no fall protection in use exposing employees to falls of approximately 20 feet.  NO ABATEMENT CERTIFICATION REQUIRED
