OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while using an improperly designed elevating platform.  a)    On or about 4/22/2016, employer was elevating employee in home made platform that did not have standard guard rails with toe board, no means of attachment to lift truck, no screen on basket to protect employee from mast operation during lift, and no certification from lift truck manufacturer for use on the lift truck.
