29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)DRM, Inc. @ Mount Rushmore Road, Rapid City, SD 57071: On and prior to 4/13/16, the exposing employer did not ensure that adequate protection was provided, in that, the spoil pile was less than 6 inches from the edge of the excavation along the east wall adjacent to Mount Rushmore Road. Employees were exposed to the hazard of the spoil pile falling into the excavation while placing a 45 degree elbow of 48 inch RCP (Reinforced Concrete Pipe). This condition caused an overburden to be placed on the vertical walls of the excavation which exposed employees to cave-in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c) (a)DRM, Inc. @ Mount Rushmore Road, Rapid City, SD 57071: On and prior to 4/13/16, the exposing employer did not ensure that each employee working on the east and west side of the excavation was protected from cave-in, in that, the excavation measured depth 5 feet 6 inches in height and lacked any protective system such as sloping, benching, or a shield system. Employees within the excavation were placing a 45 degree elbow of 48 inch RCP (Reinforced Concrete Pipe). This condition exposed employees to crushing hazards by excavation wall cave-in.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a)DRM, Inc. @ Mount Rushmore Road, Rapid City, SD 57071: On and prior to 4/13/16, the employer did not ensure that daily inspections of the excavation, that measured approximately 5 feet 6 inches in depth, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify the lack of an appropriate protective system on the east and west wall off the excavation and did not take prompt corrective action to eliminate the cave-in hazard. The type C soil in the excavation had visible cracks and fissures, in addition to sections of soil sluffing off into the excavation. This condition exposed employees to a crushing hazard by excavation wall cave-in during placement of the 48 inch RCP. Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
