29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a) PROPERTY OF AJ PALLET LLC, WOOD GRINDING AREA - Employees worked to clear the jammed clutch of the Bandit Beast 3680 wood recycler, and the employer had not established and implemented a lockout tag out program. The employer did not render the equipment safe by performing lockout tag out to ensure stored and potential energy for moving parts of the machinery were controlled, thereby causing an employee to become pinned by the in-feed yoke, on or about May 3, 2016. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
