29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used: a) On or about 5/5/16, At the job site: Employees were accessing the top (third) level of the tubular welded frame scaffold, which had a distance of twenty feet to the ground and 6.66 feet to the second level. There was no ladder or safe means of access provided. Abatement certification is required for this item.

No access was provided between the sill and floor of the building. Abatement certification is required for this item.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity): a) On or about 5/5/16, At the job site: Employees were utilizing a tubular welded frame scaffold system that was three bays wide and three stages high. Employees were working off of the top level of the scaffolding system which was not provided with any fall protection, and were working off of the second level which was provided with cross bracing on two of the three bays. Employees were exposed to falls of up to twenty feet. Abatement documentation is required for this item.
