29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. a. At the establishment, the employer had not established and implemented an effective hearing conservation program for employees with noise exposures equal to or exceeding an 8-hour time-weighted sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of 50 percent. An employee who operated the drill, grinder and polisher was exposed to noise at an 8-hour time weighted average sound level of 89.2 dBA during the 474 minute sampling period on May 26, 2016. Exposure calculation included a zero increment for the 6 minutes not sampled.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by paragraph (l): a. At the work site located at 1620 Feddern Avenue, Grove City, Ohio, employees used a fork lift truck to receive and store supplies, to move stock and finished products throughout the work site, to remove scrap material, and to load finished products for shipment. The employer had no training program for employees who operated the fork lift truck.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a. At the workplace located at 1620 Feddern Avenue, Grove City, Ohio, in the CNC area, the employer did not provide the Delta table saw with adequate guarding of the blade at the point of operation, thereby exposing employees to an amputation hazard. b. At the work site, employees operated a Jet Band Saw, model SWBS-18QT-3, serial number 003265 that had an exposed blade of approximately 4 1/2 inches at the time of inspection on May 12, 2016. The employer had not ensured that the Jet saw was adequately guarded at the point of operation, thereby exposing employees to an amputation hazard.
