29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) On the south west end section of the excavation, employees were exposed to cave-in hazards While working in an excavation with side walls at heights of 6ft. 1in. and 7ft. 1in. respectively and sloped at angles from the horizontal of 54.7 degrees and 47.6 degrees respectively. The soil present was type B. Employees were installing piping at the bottom of the excavation. b) On the south east section of the excavation, employees were exposed to cave-in hazards due to inadequate benching of type B soil. The bank walls of the section were vertical and benched 22 inches back at the top of the bank. The bench height was 1 ft. 3 in. The total height of the excavation was measured to be 6ft. 1 in. resulting in a vertical, straight wall section below the benching of 4 ft. 10 in. This violates the benching requirements of table B-1 in 29 CFR 1910.652 which require the straight wall section below the benching to be no greater than 4 ft.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) For the jobsite at 6720 S Florida Ave., Lakeland, FL 33813, as observed on or about 05/11/2016, excavations were not being inspected by a competent person. The employees inspecting the excavation were not knowledgeable of excavation depth and sloping requirements for the type of soil that was present (type B soil), did not know regulations regarding how deep it was was safe to dig in the soil that was present on site, and did not measure the depth of all the excavation areas employees were working in. Employees were exposed to cave-in hazards while working in the excavation.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) For the jobsite at 6720 S Florida Ave., Lakeland, FL 33813, as observed on or about 05/11/2016, employees working in excavations were not instructed on excavation safety standards and hazards. Employees did not know the requisite depth before excavation cave-in protection was needed, employees did not know how soil was classified, and employees did not have a general awareness of proper sloping techniques.
