Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of its employees a place of employment which are free from the recognized hazards of being struck-by and/or crushed-by forklift equipment which are likely to cause death or serious physical harm to employees:      This violation occurred on or about May 11, 2016, at the Terra Lago jobsite in Rowlett, Texas where an employee was exposed to being struck-by forklift equipment that was being used by an employee to tow a semi tractor-trailer stuck on the crane mats.      a)   Employee used a JCB Telescopic Handler forklift (model 510-56 Loadall, serial number JCB5CGXGAAA01403314) to pull a semi-tractor trailer truck.
