29 CFR 1926.451(e)(1): Cross braces were used as a means of access and egress: On or about May 11, 2016, and at times prior thereto, employees were applying stucco to the apartments under construction working from a seven tier tubular welded scaffold that had a ladder only for the first three levels. The employees used the cross braces to access the upper levels up to approximately 40 feet high, exposing the employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about May 11, 2016, the owner and employees were working from the tubular welded scaffolding to apply stucco to the residential apartments under construction without being trained to recognize the hazards of working from scaffolding, exposing employees to a fall hazard. Note: The training shall include the following areas, as applicable: a) Any electrical hazards, fall hazards and falling object hazards in the work area; b) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c) The proper use of the scaffold, and the proper handling of materials on the scaffold; d) The maximum intended load and load-carrying capacities of the scaffolds used; and e) Any other pertinent requirements of this subpart.
