OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a fall hazard.  On or about May 11, 2016, on the front of the jobsite, the employer allowed an employee to utilize an Nifty TM 34 T aerial lift without adequate fall protection while performing painting work on the exterior of the building at a height of approximately twenty (20) feet.  Feasible Means of Abatement: Ensure all platform occupants use appropriate fall protection connected to the aerial device anchorage(s), as specified in ANSI A92.2-2009 Section 10.3
