29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were conducted by a competent person:    a) Jobsite - On or before May 17, 2016, flaggers were directing traffic without flags or traffic control paddles and the employer had not initiated frequent and regular inspection of this job site.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition):    a)  Jobsite - On or before May 17, 2016, an employee was directing traffic with hand signals without the use of a flag or paddles and accordingly exposed to the hazard of being struck by either vehicular traffic or construction equipment operating nearby.    b)  Jobsite - On or before May 13, 2016 an employee was directing traffic with hand signals and was struck by a Kobelco tractor mounted excavator.
