29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1):    (a) Foothills Commercial Builders, Inc., 2490 W 26th Ave, Denver, CO 80211: On and before March 18th, 2016, the employer did not identify the presence, location and quantity of ACM, and/or PACM, and convey that information to the employees. Employees removed floor tiles and used equipment to sand down the underlying mastic.  Both the tile and mastic have been a part of the original construction of the building which pre-dates 1980. The employer has not provided documentation showing that the tile and the mastic had been tested for asbestos prior to removal and disturbance of PACM materials by employees. This condition exposed the workers to dusts that may have contained asbestos.

The program had not been developed for employee exposures, such as, but not limited, to the following:      (1) Ultraplan Easy which contains Portland cement and silica sand.      (2) Ardex Feather Finish which contains Portland cement and ethylene/vinyl acetate copolymer.    Injuries include, but are not limited to, chemical irritation and potential chemical exposure.
