29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Third Floor Deck - A carpenter was observed cutting wooden framing members with a Makita portable electric circular saw and not wearing eye protection, on or about 05/26/2016.  b) Third Floor Deck - A carpenter was observed attaching wooden framing members with a pneumatic nail gun and not wearing eye protection, on or about 05/26/2016.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Third Floor - Carpenters were observed on an unprotected deck while constructing a wood framed wall section and exposed to a 20 foot fall hazard, on or about 05/26/2016.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Access to the Third - Employees were using a portable extension ladder to gain access to the third floor and the ladder side rails only extended 26 inches above the landing, on or about 05/26/2016.  b) Access to Second Floor - Employees were using a portable extension ladder to gain access to the second floor and the ladder side rails only extended 12 inches above the landing, on or about 05/26/2016.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
