29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket was not utilized when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) Building #3, on or about June 2, 2016 or prior thereto:   An employee was exposed to a potential fall distance of 30 feet while utilizing a Grad All aerial lift to deliver nails to co-workers.  He was not wearing fall protection.  NOTE: This item was corrected during the inspection.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Roof of Building #3, on or about June 2, 2016 or prior thereto:   An employee was exposed to a potential fall distance of 30 feet at the eave while delivering nails to co-workers, and removing garbage from the roof.  NOTE: This item was corrected during the inspection.
