29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about June 17, 2016, at Material Delivery Service, Inc. the employer failed to ensure that employee(s) received medical evaluation prior to using a respirator. Employees are required to wear respirators during the performance of their job duties to protect against the hazard of exposure to such chemicals such as Portland cement, CFB Fly Ash, Hydrated Lime and Quick Lime.

29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and/or for preventing unauthorized entry. On or about January 26, 2016, at Material Delivery Service, Inc. the employer failed to ensure that procedures for prospective rescue service was developed and implemented for the confined space maintained onsite (tanker trucks). Local Fire and Rescue services were not notified of the confined space maintained onsite prior to employee entry. Employees were required to enter permit-required confined spaces at the facility.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour. On or about June 17, 2016, at Material Delivery Service, Inc. the employer failed to ensure that the Acetylene and oxygen cylinders stored on a welding cart were separated by a noncombustible barrier. Employees used the cutting torch on the day of the inspection to cut a metal plate on a trailer.
