29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means: Located along the side and rear perimeter exterior area of the commercial structure employees were observed working from two self-supported tubular welded frame tower systems with a 5 foot wide minimum base erected to a height in excess of 26 feet without the scaffold tower systems being secured to the structure or equivalent.

29 CFR 1926.451(e)(6)(i): Integral prefabricated scaffold access frames shall be specifically designed and constructed for use as ladder rungs; Located along the front, side and rear perimeter exterior area of the commercial structure employees were observed gaining access to three self-supported tubular welded frame tower systems by climbing the walkthrough scaffold end frames which were not specifically designed and constructed for such use in that rung lengths were less than 7 inches wide, rungs were not uniformly spaced and the rung spacing exceeded 16 ¾ inches in that the rung spacing was 13, 21, 18 and 22 inches between each rung, exposing employees climbing the end frame legs to fall potentials in excess of 13 feet.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Self-supported tubular welded frame scaffolding systems were not erected and used under the supervision of a competent person, in that a competent person qualified in scaffold erection did not supervise installation of protection from tipping, standard guardrails and compliant ladder access or equivalent to ensue such systems were erected or properly utilized.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Located along the front, side and rear perimeter exterior area of the commercial structure employees were observed working from three self-supported tubular welded frame tower systems that were not protected by standard guardrails or personal fall arrest systems exposing employees to fall potentials in excess of 11 feet on two of the scaffold systems and in excess of 13 feet on the other scaffold system..
