29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a) On or about June 17, 2016 or prior thereto:  Spoil piles were placed on the west edge of the one-sided residential excavation.  Materials were not placed at least 2 feet from the edge of the excavation.   The depth of the excavation was 9.7 feet.    NOTE:  Abatement certification and documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.   a) On or about June 17, 2016 or prior thereto:  Inspections of potential cave-in hazards to include soil fissuring on the north face of the excavation, and fissuring in soil on the west side of the excavation, were not conducted.  In addition, a determination of soil classification was not conducted.   The depth of the excavation was 9.7 feet at its deepest point.  NOTE:  Abatement certification and documentation are required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a) On or about June 17, 2016 or prior thereto, north wall excavation, underneath the entrance ramp to the property:  The excavation was sloped approximately vertically (90 degrees) at a depth of 7.9 feet and fissuring was present.     NOTE:  Abatement certification and documentation are required for this item.
