29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) On or about June 21, 2016, and at times prior thereto, employees were using a Keller, Type III Household Duty aluminum extension ladder to access a flat roof.  The top rung was only slightly above the upper landing surface.    NOTE: Abatement certification is NOT required for this item.  Corrected during inspection.

A Keller Type III Household duty aluminum extension ladder was used with multiple bends, dents, and damage.  NOTE: 29 CFR 1926.32(f) defines a "Competent Person" as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
