29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:  a.) DuBois Regional Medical Center DBA Penn Highlands DuBois Neurology - On or about June 20,2016, the annual consideration and implementation of appropriate commercially and effective safer medical devices for devices including, but not limited to, Excel Hypodermic 30g needles, Monoject Standard Hypodermic 30g 3/4" needles, and BD Spinal needles was not documented in the employer's exposure control plan.  Employees were at an increased risk of exposure to blood or other potentially infectious materials when assisting practitioners during procedures where needles that were not equipped with safer engineered technology were in use. Evaluations were last documented in 2014.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  a.) DuBois Regional Medical Center DBA Penn Highlands DuBois Neurology - On or about June 20,2016, the employer had not documented, in the exposure control plan, the solicitation of input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps while utilizing devices including, but not limited to, Excel Hypodermic 30g needles, Monoject Standard Hypodermic 30g 3/4"needles, and BD Spinal needles. Solicitation, documented in the exposure control plan, did not include employees who utilized the devices.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employees exposure:  a) DuBois Regional Medical Center DBA Penn Highlands DuBois Neurology - On or about June 20,2016 employees were at an increased risk of exposure to blood or other potentially infectious materials when assisting practitioners during Botox procedures where needles that were not equipped with safer engineered technology were in use.    b) DuBois Regional Medical Center DBA Penn Highlands DuBois Neurology - On or about June 20,2016 Employees were at an increased risk of exposure to blood or other potentially infectious materials when assisting practitioners during lumbar puncture procedures where needles that were not equipped with safer engineered technology were in use.       The employer had not demonstrated and documented that there were no feasible alternatives available or that use of such non-safety engineered device was required by a specific medical procedure.
