29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a)Knudson Masonry, LLC @ 314 Main St., Sioux Falls, SD 57104: On and prior to July 6, 2016, an employee was working from an aerial lift basket attached to a boom with no fall protection. This hazard exposed the employee to a fall of approximately 20 feet. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace: (a)Knudson Masonry, LLC @ 314 Main St., Sioux Falls, SD 57104: On and prior to July 6, 2016, the employer did not identify and evaluate the respiratory hazard in the workplace. An employee was grinding joint mortar using portable right angle grinders. The grinding process generated respirable dust. Employee exposure to respirable dust had not been determined. This condition potentially exposed employees to a respiratory hazard.
