29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about July 8, 2016, employees performing residential masonry operations were exposed to struck by hazards while employees worked on installation on two levels without hardhats. The employer failed to mandate the use of hard hats. Abatement certification is required of this item in accordance with requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about July 8, 2016, employees were performing masonry work on the chimney of a residential structure from the roof and were exposed to falls greater than 25' when the employer failed to ensure that fall protection was utilized. Abatement certification or documentation is not required for this item.
